WAREHAM — The Wareham Department of Natural Resources is filing a charge of cruelty to animals against a man who allegedly threw a small dog into a dumpster because he was tired.

Wareham DNR Officers responded to the Lakeside Trailer Park at 3030 Cranberry Highway on Sunday after receiving a report of a man throwing a dog into a dumpster on the premises.

Upon arrival, DNR Officers observed a man retrieving a small black and white dog from a dumpster. The man, who appeared visibly upset, identified himself to officers as the dog's owner. He allegedly told officers that another man who is staying at his home had thrown the dog into the dumpster.

Officers also spoke with a witness who told them they had seen a man exiting the dog owner's house while holding a small black and white dog. The witness said the man lifted the dog over his head and threw him into the dumpster.

Wareham DNR Officers confronted the individual identified by the dog owner as James Balboni, 28, of Dover, New Hampshire. Balboni reportedly told officers that he had thrown the dog into the dumpster because "he was tired, had not slept, and the dog would not stop bothering him," according to a release.

Balboni has been charged by the Wareham Department of Natural Resources with one count of cruelty to animals. He is scheduled to be arraigned on the charge at Wareham District Court at a later date.

The dog did not sustain any injuries as a result of the incident and is in the possession of its owner.
