A Bristol County Superior Court judge has ruled in favor of the Town of Fairhaven in a lawsuit concerning the town's wind turbines.  23 members of Windwise, the group opposed to the turbines, filed suit against the town in December of 2011 alleging that the north turbine's lease was invalid because it was built on lot 9, instead of lot 8A  as authorized by the town.

In his ruling,  Judge Llyod MacDonald found that regardless of what was written in an article approved by town meeting, members were aware of the exact location of the turbines when they passed it. Select board Chairman Brian Bowcock tells WBSM news the judge's decision vindicates the town.

The judge called the town meeting article's incorrect reference to lot  8A as an inadvertant clerical error. Windwise Attorney Ann Denardis said that she and her clients of Windwise are discussing their options on how to proceed.
