DUXBURY — The parents of a Massachusetts man who died of a drug overdose last year have sued their son’s middle school gym teacher who they allege repeatedly raped him.

Joseph and Melissa Foley are seeking $1 million in a lawsuit filed in Plymouth Superior Court that also names the Duxbury Public Schools as a defendant for allegedly failing to protect their son. Joseph Parker Foley died last October at age 27.

The superintendent of Duxbury schools as well as a lawyer for the gym teacher denied the allegations. Police investigated but did not charge the teacher, John Blake, who has been placed on leave.

Blake’s attorney, Kevin Reddington, told the Boston Globe his client denies the allegations and called the lawsuit “malicious.”
