The death of a 12-year-old shot by Cleveland police last month is being ruled a homicide.

The Cuyahoga County medical examiner's office released its findings in the Tamir Rice case today.

Rice was playing with a toy gun, prompting a 911 call from a man who told the dispatcher it may be fake but it was scaring people. Officer Timothy Loehmann opened fire on Rice within two seconds of arriving on the scene. Police have said Rice reached for his waistband.

Rice's family has filed a lawsuit against Loehmann, his partner, and the city.

The homicide ruling comes a week after a Department of Justice report that Cleveland police regularly are quick to pull their guns and often fire on people who are not a threat.  (Metro Network Inc)
