A Superior Court Judge has the results of the April 1st Board of Health Election in Fairhaven, "null and void" because of issues with the ballot counting and other discrepancies.  Judge Robert Kane issued his ruling Monday afternoon.  The ruling seems to clear the way for a new Board of Health election.

Attorney Ann Denardis, representing challenger John Wethington, says she and her client are pleased with the ruling.

Judge Kane however refused to order a new election, leaving that to Fairhaven officials.  The town attorney and the town clerk have already said they're in favor of a new election.

Peter De Terra, the man declared the winner by one vote following a recount said through his attorney, he will accept the ruling by Judge Kane that a disputed ballot was a blank, and will drop his appeal.
