UPDATE: The Fall River Police Department has now identified the member of the department who was arrested as David Silvia.

FALL RIVER (WBSM) — A Fall River police officer is accused of breaking into a home while heavily intoxicated.

According to Fall River Police, a man was reportedly banging on the front door of a home in the early-morning hours of May 27, and repeatedly asking for a woman by name. The resident called police, who arrived to find that the man had allegedly forcibly entered the residence and continued to ask for the woman, and then left when he was told that nobody by that name lived at that address.

The resident was able to give police a description of the suspect, and described him as “heavily intoxicated” and that he “appeared to be confused or mistaken about the location.”

The suspect was soon located about a half a block away, allegedly exhibiting signs of intoxication. He was detained and identified as a member of the Fall River Police Department, police said.

“It is common practice for law enforcement, when encountering individuals under the influence who have unknowingly trespassed onto private property, to use discretion and arrange for medical treatment if needed,” police said. “However, in this case, given the subject’s status as a police officer and the higher standard to which officers are held, no discretion was exercised. A criminal complaint report was authored and submitted to the court for further action.”

Police did not identify him, but said his name would be released upon his arraignment in court.
