A resolution to the hotly-contested Fairhaven Board of Health election could come Monday...or maybe not. 

Incumbent Peter De Terra was declared the winner by one vote following a recount. 

Challenger John Wethington then filed suit in Superior Court, seeking a new election. His attorney claimed there were irregularities in the counting of ballots. 

Superior Court Judge Robert Kane is taking a close look this weekend at two contested ballots, and promised a ruling by Monday morning. 

De Terra's attorney John Markey Jr.  tells WBSM News, its possible both candidates could find themselves tied on Monday....

The two ballots in question were ruled to be votes for De Terra during the recount held last month.  If one vote is tossed by the judge, the race would be tied.
