Fairhaven Musician Convicted of Indecent Assault

FAIRHAVEN — The lead singer of a popular local rock band has been convicted for indecent assault and will serve jail time and register as a sex offender, according to the Bristol County District Attorney's Office.

James Gagne, 39, of Fairhaven was convicted by jury trial on Wednesday of indecent assault and battery on a person over 14, the D.A.'s office said.

The musician and singer for rock group Shipyard Wreck was sentenced to serve nine months in the Bristol County House of Correction, with two years of probation after his release.

The details of the assault are sealed due to the nature of the charges.

Fairhaven Police Lieutenant Kevin Kobza confirmed that the incident took place at a local bar on Aug. 4, 2018, although he said he was unable to confirm other details due to the sensitive nature of the case.

He did say that the victim of the assault was an adult.

According to the District Attorney's Office, Judge David Sorrenti handed down Gagne's sentence after the jury returned a guilty verdict on Aug. 18.

The conditions of Gagne's probation are that he stay away from the victim, and remain drug and alcohol free.

He must also register as a sex offender.

Gagne was represented by Attorney Gregory Tinsworth and the case was prosecuted by Assistant District Attorney Robert Fread.
