A court hearing to determine whether there should be a new Board of Health election in Fairhaven will likely wrap up Tuesday  or Wednesday. 

Incumbant Peter De Terra was the declared winner by one vote back in April, following a recount. 

But challenger John Wethington filed suit, claiming there were discrepancies in the vote-counting. 

Last week, Superior Court Judge Robert Kane ruled a vote previously declared for De Terra, was a "blank", technically leaving the election a tie. 

De Terra's attorney, John Markey Jr. says there's one legal issue to be decided about whether a Standard Times reporter will be allowed to testify, and then the hearing will move into its final stages....

Judge Kane has indicated he plans to issue his decision on a new election on Monday, the 17th.
