An attempt by the attorney's for 18-year-old Michelle Carter to dismiss her case has been taken under advisement.

Greg Miliote, a spokesman with the Bristol County District Attorney's Office, says Juvenile Court Judge Bettina Borders made the announcement Monday morning and a ruling is expected when court resumes on October 2.

Carter, who was 17-years-old at the time,  is being charged with involuntary manslaughter with prosecutors saying she sent texts to 18-year-old Conrad Roy III encouraging him to end his life after Roy sent texts that suggest he was having second thoughts about committing suicide.

However, Carter's attorneys say the prosecutors are only releasing one sided conversations, and they say some texts suggest carter encouraged Roy to get help.

Carter's attorneys filed to have the case dismissed arguing that the prosecution doesn't have sufficient evidence.
