A medical marijuana dispensary may still be moving into the former lottery building in Fairhaven. It just won't be the one residents are familiar with.

The Board of Selectmen agreed to submit a letter of support on behalf of Costal Compassion Monday night.

The group has reached an agreement with Brighton Health Advocates to sub-lease the property. Costal Compassion President Tim Keogh says the board's support is a major step in moving their application along.

The group's application with the state must be submitted by August 29th. They must also receive support from the town's Board of Health and police department.

Brighton Health Advocates was planning to open the Compassionate Care Clinic at the Pequod Road location, but their application is currently in an appeal process with the state.

The Department of Public Health says their appeal is now subject to a decision by Massachusetts Superior Court. They will be eligible to re-apply for a dispensary in July of 2015.

The DPH ruling on Costal Compassion is expected around late October of this year.
