Could Falmouth Wind Decesion Impact Fairhaven?


In what is believed to be the first time a court in the U.S. has ruled in favor of evidence that wind turbines near residential areas are a health hazard to families living nearby, Barnstable Superior Court Judge Christopher J. Muse has ordered the Falmouth turbines to run with limited hours of operation. Neil and Elizabeth Andersen, who live about a quarter mile away from the turbines convinced the court they suffered health issues since the turbines’ construction three and a half years ago. The Andersen’s said, “This isn’t an anti-wind thing, this is direct negative effects from massive wind turbines.” Judge Muse said,”The court finds the Andersens’ claims that they did not experience such symptoms prior to the construction and operation of the turbines, and that each day of operation produces further injury, to be credible. There is a substantial risk that the Andersens’ will suffer irreparable physical and psychological harm if the injunction is not granted.” Some local residents are wondering if a decision like this one could also have bearing on the Fairhaven case?
