A judge hears arguments on whether the recall election to remove Fall River Mayor Will Flanagan from office should be allowed to go forward.

Attorneys for the petitioners and Mayor Flanagan appeared before Judge Thomas McGuire on Monday, who pledged to rule as quickly as possible.

Attorney Lesley Rich, representing the recall petitioners, says the case is now in the hands of the judge....

Rich is referring to the two-part recall ballot. The first half asks voters whether Mayor Flanagan should be removed from office, the second half lists candidates to succeed him.

Flanagan's attorney, Preston Halperin, says the Mayor should be on the second half of the ballot, to give his supporters the chance to vote for their candidate.

The recall election is scheduled for December 16th.
