A former Bush administration official says George W. Bush would have made the same decision that President Obama made in swapping five Taliban detainees for the release of Army Sergeant Bowe Bergdahl. John Bellinger broke with Republicans yesterday by saying when confronted with the opportunity to get Bergdahl back, he thinks the Bush administration would have done so.

He added in his opinion, these particular Taliban detainees "could never have been tried in federal court."

Bellinger served as the legal adviser for the State Department and the National Security Council during the George W. Bush administration.
