Speaking with the Executive Director of The Lawyers Committee for Civil Rights, I learned that just improperly entering the United States, or over staying your visa is mostly a civil violation. It can still be punishable with a deportation order--but as long as there's no other criminal activity associated with entering or over staying, the Immigration and Nationality Act treats this form of immigration as a civil infraction.
