SJC To Hear Arguments in 1993 Lakeville Murder Case

A man convicted in the rape and murder of an 83-year-old woman is asking Massachusetts' highest court to order prosecutors to give him access to biological evidence found at the crime scene so he can do DNA testing.

    Robert Wade's lawyers say the DNA testing would support his claim of innocence. His case will test the parameters of a 2012 law that provides a mechanism for defendants to seek DNA testing after their convictions.

    The Supreme Judicial Court will hear arguments Monday in Wade's case and a companion case.

    The woman suffered a broken hip in the 1993 attack at a Lakeville pig farm. She died three weeks later of complications.

    Prosecutors say Wade isn't entitled to the DNA because his trial attorney strategically decided not to seek the testing.
