Attornies for Steve and Kevin Carter, the sibling owners of Carter's Clothing in downtown New Bedford, are waiting to hear from a federal judge whether their lawsuit against Nike will proceed.

The brothers filed suit against the shoe giant after their contract to carry the popular brand was suddenly terminated over the summer.

Adrienne Beauregard, an attorney for Carter's tells WBSM News Nike has apparently terminated contracts with other small retailers across the country. She says Carter's held a contract with Nike for 28 years, and always adhered to it.

Attornies are arguing Nike is terminating contracts with small, independent retailers in favor of bigger box stores.

Lawyers for Nike say the case cannot be heard in Massachusetts, and must be presented in Nike's homestate of Oregon.

Federal Judge Douglas Woodlock will decide whether the suit can proceed in Massachusetts.
