A Fall River Superior Court Judge says prosecutors in former Patriots star Aaron Hernandez's murder case cannot have recordings of his jailhouse phone calls.

The Judge says prosecutors didn't make a sufficient case for the records, but may try again.  Defense Attorney James Sultan called the motion "a fishing expedition." 

Aaron Hernandez is currently awaiting trial at the House of Correction in Dartmouth for the murder of Odin Llloyd of Boston last summer. 

Judge Susan Garsh did give the prosecution a win on Friday;  ruling that prosecutors do not have to prove Hernandez fired the shots that killed Lloyd in order to get a murder conviction. 

The Judge said proseuction simply had to prove he participated in the crime.  Four others have also been charged in connection with the murder.
