A Massachusetts man has withdrawn his no contest plea to charges that he killed his girlfriend when he crashed his car while drunk and fleeing police in Rhode Island.

Brandon Borge, of Fall River, Massachusetts, was set to be sentenced Tuesday in Superior Court in Providence to charges of driving to endanger, death resulting and driving under the influence, death resulting.

Borge's girlfriend, 34-year-old Barbara Ellis, was killed in April 2012 during the high speed chase. Ellis died in the car after it hit a concrete wall. Borge lost both legs.

Borge said in court he remembers nothing about the accident.

Prosecutors had recommended a sentence of no more than 10 years. The case could now go to trial.

His lawyer could not be reached for comment.
