MA Mom Wants New Trial in Son’s Death

A Massachusetts woman sentenced to up to 10 years in prison for withholding potentially life-saving medication from her autistic, cancer-stricken son has asked a judge for a new trial.

A new lawyer for Kristen LaBrie told a judge Tuesday that her trial lawyer was ineffective and had no experience presenting the "diminished capacity" defense he used at her April 2011 trial.

LaBrie was convicted of attempted murder for withholding at least five months of at-home chemotherapy treatments for her son Jeremy Fraser. The boy died at age 9 in 2009. Jeremy was autistic, nonverbal and developmentally delayed. He was diagnosed with non-Hodgkins lymphoma shortly after he turned 7 in 2006.

Prosecutors are reportedly opposed to the motion for a new trial.

The judge did not immediately rule.
