Independent candidate for Massachusetts governor Evan Falchuk has gone to court to try to force the organizers of an Oct. 27 gubernatorial debate to include him.

Falchuk said he was asked to participate in the debate, but then was told by NECN that he was no longer invited.

Falchuk said Wednesday that he has filed a lawsuit in Suffolk Superior Court seeking to force debate organizers to permit him to participate in the debate.

Falchuk is one of three independent candidates on the ballot including Scott Lively and Jeff McCormick. All three have polled in the low single digits.

Falchuk alleges a breach of contract, saying organizers applied "new, unspecified conditions" to retract his invitation.

A message seeking comment was left with NECN.

The two major party candidates are Democrat Martha Coakley and Republican Charlie Baker.
